Forensic Accounting and Litigation Support Services

Ian Cherry leads a team providing Forensic Accounting and Litigation Support Services.

Ian Cherry has been instructed by both claimant and defendant solicitors to advise the Court on claims for loss of profits and other matters as a Forensic Accountant and Expert Witness. He has been instructed as a Joint Expert on many occasions. In addition, he has been instructed by The Criminal Injuries Compensation Authority to advise on quantum of loss of earnings in criminal cases.

He has given evidence in The Royal Courts of Justice on several occasions, together with many appearances in County Court, Crown Court, and before employment and other tribunals. Ian is a qualified arbitrator and a panel member of the President’s appointments and referrals scheme of the Institute of Chartered Accountants in England and Wales. He has carried out many referrals.

He has prepared reports on quantum in cases of personal injury, fatal accidents, medical negligence, professional negligence, matrimonial disputes, commercial matters, company valuation disputes and fraud cases, money laundering and Proceeds of Crime Act applications.

Forensic Accountants

Ian advised in the case of Kelly -v- Dawes, the first structured settlement achieved in this country. He has advised in other cases involving structured settlements.

Ian has appeared on radio and television commenting on forensic accounting matters and corporate fraud. He has written articles which have been published in specialised legal papers, accountancy magazines and press and was a consultant editor on a reference book written for forensic accounting practitioners. He has lectured on forensic accounting and fraud to fellow practitioners, solicitors and insurers and given presentations to lawyers and specialist groups of legal practitioners. He has also had several letters published in The Times on various accounting matters.

In addition to his forensic work, Ian is a registered auditor carrying out accountancy, tax and audit work for a wide range of Clients.

Specific areas where we offer advice and support

Independent arbitration services which are performed under the Arbitration Act (1996), including contractual or partnership disputes where independent mediation can facilitate a resolution without the need for litigation.
Banking investigations includes tracing claims in contractual disputes; analysis of bank statements and bank records in criminal cases to establish quantum of theft.
The evaluation of the value of private businesses for use in matrimonial proceedings or contractual disputes.
Contractual disputes to evaluate potential loss or damages.
Assisting the defence or prosecution in criminal cases involving the Proceeds of Crime Act (2002), applications to identify or eliminate assets that can be traced to the proceeds of crime.
Acting as an Expert in criminal cases, for example, complex thefts of assets, duty evasion, tax evasion and complex fraud cases.
The President’s appointments and referral scheme of the Institute of Chartered Accountants in England and Wales (ICAEW). Typically includes many contractual or partnership disputes, for example, determining the closing value of assets on the dissolution of a partnership.
Legal disputes involving litigation where accountancy matters are involved necessitating a report to the Court and appearance in court or before a tribunal.
The determination of loss of dependency in fatal accident claims brought under the Law Reform Act (1934) and the Fatal Accidents Act (1976), and includes the determination of earnings and pension in loss dependency cases, the deduction for expenditure on self and joint purse approach to the evaluation of loss of dependency.
Advice in cases brought under the Fraud Act (2006), or regulatory cases brought by regulatory bodies.
Valuation of financial losses in cases involving road traffic accidents, business interruption and liability insurance.
Reports and/or advice in cases involving Intellectual Property including royalties disputes, loss of profits, copyright and the valuation of goodwill.
Valuation of quantum loss of earnings in negligence cases, for example, road traffic accidents and fatal accident cases which also includes commercial disputes and professional negligence cases. Additionally, the valuation of loss of pension in cases of loss of earnings or fatal accidents.
Valuation of businesses used in matrimonial disputes, evaluation of the parties involved in terms of their past and future earnings potential in matrimonial disputes and valuation of pensions.
Valuation of loss of earnings and pension in PI claims typically arising from road traffic accidents.
Tracing claims in the Proceeds of Crime Act application. Please also see Professional Negligence below.
Investigations and reports into professional negligence claims typically arising from advice given or failed to be given by professionals, for example accountancy advice regarding complex tax matters.
This focuses on providing an opinion on quantum of loss in litigation disputes.
Expert reports and advice arising from HMRC tax investigations.
This includes business valuations, goodwill valuations, asset valuations, royalty valuations, loss of income streams and business interruption cases.
